Article 1 - Preamble The present conditions of sale are concluded, on the one hand, by the company Fan2pieces (KNInformatic SCS) whose registered office is located at Rue Nicolas Neuray, 9 to 4801 Stembert, registered with the Crossroads Bank of the Companies under the number 0725.686.001 hereinafter referred to as "the seller" and, on the other hand, by any natural or legal person wishing to make a purchase via the seller's website, hereinafter referred to as "the buyer"
Article 2 - Purpose The present conditions of sale aim at defining the contractual relations between the salesman and the purchaser as well as the conditions applicable to any purchase made through the site of the salesman, that the purchaser is professional or consumer. The acquisition of a good or a service through the present site implies an acceptance without reserve by the purchaser of these conditions of sale. These general conditions of sale are considered to be accepted by our customers, even if they would be in contradiction with their own general or particular conditions of purchase. The latter only bind us if we have accepted them in express terms in writing. Our agreement can not, under any circumstances, be inferred from the fact that we would have accepted the contract without protesting against the stipulations that refer to the general or special conditions or other similar provisions of our buyer. The seller reserves the right to modify his conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.
Article 3 - Characteristics of the goods and services offered The products and services offered are those listed in the catalog published on the seller's website. Each product is accompanied by a description established by the supplier or the seller. The photographs in the catalog are as faithful as possible but can not ensure a perfect similarity with the product offered, particularly with regard to colors. These products and services are offered within the limits of available stocks. If, despite his efforts, all or part of the items are unavailable, the seller informs the buyer by email as soon as possible and offers him the opportunity to choose between wait or cancel without charge the order of unavailable items. The available items will be delivered normally.
Article 4 - Prices The prices of products and services displayed on the site are indicated in euros all taxes included (VAT and other applicable taxes). Article 5 - Geographical zones The online sale of the products and services presented on the seller's website is reserved for buyers who reside in Europe and for deliveries required in these geographical areas.
Article 6 - Orders The buyer who wishes to buy a product or a service must:
register on the https://fan2pieces.com website via the "Customer Area" menu;
fill in the identification form on which he will indicate all the required contact details;
finish the order after checking it;
confirm your order and payment by making the payment in the conditions provided;
The confirmation of the order implies acceptance of these conditions of sale, the acknowledgment of having perfect knowledge and the waiver of its own conditions of purchase or other conditions. All data provided and the recorded confirmation will be worth proof of the transaction. Confirmation will be worth signing and acceptance of transactions. The seller will communicate by e-mail confirmation of the registered order.
Article 7 - Right of withdrawal and Complaints
Waiver: In accordance with the law, the consumer has the right to notify the seller that he renounces his purchase, without penalty and without giving any reason, within 14 working days from the day after the day of delivery of the product or the conclusion of the service contract. This right of cancellation does not belong to the professional buyer. Within this period, the consumer must notify his intention to renounce by e-mail and return, at his expense and risk, the product delivered to the headquarters of Fan2pieces: Rue Neuray 9 4801 Stembert Products must be returned imperatively in their original packaging, undamaged, accompanied by all their accessories, the user's manual as well as the original invoice / delivery note, the products must not have been unpacked, unsealed, used in any way. In the event that all these conditions are respected, Fan2pieces undertakes to make a possible refund (excluding postage and processing orders), within 30 days, after acceptance of the return of the goods.
Complaints: Any complaint, concerning the goods supplied, must reach us by registered letter within five days of reception, by referring to the number of invoice or, failing that, of the note of sending. After this period, the claim will no longer be taken into consideration. No return of merchandise will be accepted unless prior written agreement from us and provided that they are returned to us in good condition and in their original packaging. A return number (RMA), obtained from our customer service, must be clearly mentioned on the packaging. Any complaint concerning our invoices must be brought to our attention by registered letter within 10 days of their receipt. Otherwise, they will be considered accepted without any reservation. A claim can not, in any case, justify a delay or a suspension of payment.
Article 8 - Terms of payment Payment is by credit card, Visa, Mastercard, Paypal or bank transfer or by bancontact. The items ordered remain our exclusive property until full payment of the order by the buyer.
Article 9 - Deliveries and delivery costs Delivery charges are calculated automatically according to the weight and dimensions of the package and their destinations. Deliveries are made to the address indicated on the order form which can only be in the agreed geographical area. The goods are transported at the risk of the seller until the delivery of the goods to the address of the delivery specified by the buyer. From this moment, the buyer assumes the risks alone. Delivery times are given for information only and are not mandatory. Unless expressly stipulated otherwise by us, a delay in delivery can not, under any circumstances, entitle the cancellation of an order and no compensation may be required. We reserve the right to make partial deliveries, constituting as many partial sales. The partial delivery of an order can not justify the refusal of payment of the goods delivered. Orders with a delivery time of more than one month are accepted, subject to price increases imposed by our own suppliers and circumstances beyond our control that would later render impossible or more expensive the delivery. In any case, the goods will be billed according to the tariff conditions in force at the time of the supply date, regardless of the price at which they would have been confirmed or whatever the time or the possibilities of supply.
ARTICLE 10 - Undelivered parcels The postal address provided must be valid. If a package is returned to us because the address is incomplete or incorrect, you will be asked for additional shipping charges for a new shipment. If a package is indicated as "delivered" on the tracking of the Post but indicated as not received by the customer, then the customer must ask his agency in charge of its delivery to open an investigation. If the investigation results in a definitive loss, the customer can be compensated for the insurance of the package if it is applicable.
ARTICLE 11 - Damaged or open parcels The parcel must imperatively be checked upon receipt. If there are any signs of transport damage, or signs of opening, please note it clearly on the receipt before signing it and send your complaints to the postal service itself. Any claim without a report on the receipt will be rejected.
Article 12: Returns, exchanges, withdrawal periods and liability In case of return under warranty cover, the return to Fan2pieces, is the responsibility of the customer while the return of the package to the customer (replacement or repair) is entirely at the Fan2Pieces charge. In case of return out of warranty cover, the shipping costs to Fan2pieces AND the return costs to the customer will be entirely the responsibility of the customer.
Article 13 - Guarantee With regard to consumers, the seller guarantees the products he sells and the services he provides in accordance with the law of 1 September 2004 on the protection of consumers in case of sale of consumer goods ( Articles 1649 bis to 1649 octies of the Civil Code). In case of nonconformity of a product sold found within 2 months of delivery of the goods, the consumer must notify the seller as soon as possible in a precise manner by registered letter or electronic mail. This warranty only covers existing defects of conformity at the time of delivery of the goods. Defects or damage due to misuse, such as water damage, oxidation, falling or shock, neglect and wear, are not covered by the warranty. Article 14 - Liability The seller, in the process of selling online, is bound only by an obligation of means; it can not be held responsible for damage resulting from the use of the Internet network such as data loss, intrusion, virus, service interruption, or other involuntary problems. The data included on the site are also given in good faith. The proposed links to the sites of the manufacturers and / or partners are given for information purposes. The seller can not be held responsible for information from these sites.
Article 15 - Intellectual Property All elements of the seller's site are and remain the intellectual and exclusive property of the seller. Any dispute relating to this contract will be exclusively regulated according to the law applicable in Belgium.
